A United States federal court has ruled that women are free to display their breasts in public.
The ruling was reached due to the court deciding that there’s no difference between male and female breasts.
This judgment is something that will empower many, but likely anger others.
In this contemporary day and age, the topic of displaying breasts in public is a controversial one.
The subject of whether an individual should have the right to be naked in public or not has been a battle, to say the least.
Naturally, the debate tends to lead to a question of morals and principals, and nudity is often thought of as “filthy” and profane by a lot of people.
When you take a look at places like Europe, there are specific locations a person can go to and remain in the nude without being judged.
In some regions, such as The Middle East, for example, an individual (primarily women) would be penalized for going anywhere in their birthday suit.
Some locations here in the United States have their own laws concerning being naked as well.
These laws also stipulate as to how people should cover themselves in public.
As you have probably already noticed, recently, there’s been an increase from activists in promoting an end to these restrictive laws.
The taboo of sex and the body here in the United States is one that will not die off so quickly.
Displaying naked breasts in public
Have you ever heard of an activist group called Free the Nipple?
They have staged numerous demonstrations throughout various locations, collecting partially nude and such.
They think as lots of others do, that female breasts ought to not be sexualized.
The group also believes that women should have the right to choose whether to show their breasts in public.
This specific case was caused because of a law that the Municipality of Fort Collins in the state of Colorado passed back in 2015.
It was a law specifying that unless a female was breastfeeding or under the age of 9 she was not permitted to be partially nude in public.
This legislation was discrimination at it’s finest.
Their thinking was that it would be viewed as an interruption and interrupt order among the neighborhood.
How ridiculous is that?
Male and female breasts considered the same
This law was challenged in court shortly after in 2016 by the group highlighted above: Free the Nipple.
They obtained an injunction on the law, protesting the that the law is prejudice and restrictive toward females.
The only method to make this law fair was to also ban males from revealing their breasts in public.
Otherwise, they would need to remove the law entirely.
City authorities countered this by attempting to say that male and female breasts were different and should be treated uniquely.
Of course, when everything was stated, and all the facts of the case were presented before the court, District Judge R. Brooke Jackson gave an injunction on the ordinance No. 134 on the premises that the law is prejudiced versus ladies and that it also sexualizes female breasts.
This ruling is a big win for those who follow the Free the Nipple movement.
The court stated that the primary difference in between male and female breasts is merely the capability to breastfeed.
This difference is not considered sufficient to get different treatment from the government.
“I find that the ordinance victimizes females based upon the generalized idea that, no matter a woman’s intent, the exposure of her breasts in public (or even in her private house if viewable by the public) is always a sexualized act.
“Therefore, it perpetuates a stereotype implanted in our society that female breasts are mostly things of libido whereas male breasts are not.”
Not over yet
While this is not over, however, Jackson thinks that this regulation violated the Equal Protection Clause which Fort Collins has actually discriminated versus females.
It appears the city is going to hesitate when it pertains to quitting in this case.
It seems we will have to wait and see exactly what happens in the times to come.
